Terms of Service
Last updated: October 3, 2026
These Terms of Service ("Terms") govern your use of glennfranksax.com (the "Site") operated by Glenn Frank LLC, a live saxophone entertainment company based in New York ("we," "us," "our"). By using the Site or submitting a booking inquiry, you agree to these Terms. Questions: glenn@glennfranksax.com.
Site use
- Use the Site only for lawful purposes and honest event inquiries
- Do not attempt to disrupt the Site, scrape it aggressively, or bypass security controls
- Content on the Site (text, photos, audio, video, logos) is owned by Glenn Frank LLC or used with permission. You may not copy, redistribute, or perform publicly without written consent
Inquiries, quotes, and bookings
Submitting the contact or intake form does not by itself create a binding contract. A performance is confirmed when both parties agree to terms in writing (including email) and any required deposit is received.
Payment terms stated on the Site apply unless your signed quote says otherwise: 50% is due at the time of booking to confirm your date. The remaining balance is due 30 days before the event.
You are responsible for providing accurate event details, timely responses, and a safe, lawful venue environment.
Cancellations and rescheduling
If you need to cancel or move your date, notify us as soon as possible at glenn@glennfranksax.com. Specific refund or credit terms will be stated in your booking agreement. Unless your contract says otherwise:
- Deposits may be non-refundable once your date is held, because that date is removed from our calendar
- Rescheduling is subject to availability and may require updated fees for travel or peak dates
- If we must cancel due to emergency or force majeure, we will offer a refund of amounts paid for the unused performance or work with you in good faith to rebook
Performance, equipment, and venue
- We will perform professionally and bring standard saxophone and related gear appropriate to the agreed package (including LED sax when booked)
- The client provides adequate power, a reasonably safe performance area, and cooperation with venue staff
- Sound levels follow venue rules and reasonable requests. Extreme noise restrictions or hazardous conditions may limit the performance
- For details on technical needs, see the Tech Rider linked from the Site footer
Recordings and publicity
Unless agreed in writing, we may capture photos or short clips for portfolio or marketing use, respecting guest privacy and venue rules. If your event is private and you need restrictions, tell us before the event.
Disclaimer of warranties
The Site and any information on it are provided "as is" without warranties of any kind, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Glenn Frank LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of the Site or a performance. Our total liability for any claim related to a confirmed booking is limited to the fees you paid to us for that event.
Indemnity
You agree to indemnify and hold Glenn Frank LLC harmless from claims arising from your misuse of the Site, inaccurate information you provide, or your event's violation of law or venue rules, except where caused by our gross negligence or willful misconduct.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be brought in courts located in New York, unless otherwise required by applicable law.
Changes
We may update these Terms from time to time. The "Last updated" date will reflect changes. Continued use of the Site after updates means you accept the revised Terms.
